Terms & Conditions (HoT Entertainment)

1) Who we are
These Terms govern admission to concerts, comedy shows, fashion shows, and combat-sports events promoted by [HoT Entertainment] in the County of Hawaiʻi (Hawaiʻi Island), State of Hawaiʻi.
2) Tickets, pricing, and taxes
• All prices are listed in U.S. dollars and, unless stated otherwise, do not include Hawaiʻi General Excise Tax (GET) + County Surcharge.
• Applicable tax to pass on in Hawaiʻi County: 4.712% (this is the State GET 4.0% + County Surcharge 0.5%, “grossed-up” when visibly passed on). Example: a $100.00 ticket → tax $4.71 → total $104.71.
• We may (a) quote tax-exclusive prices and add 4.712% at checkout, or (b) quote tax-inclusive prices and disclose the embedded tax. Either way, the tax is our legal responsibility; when we “pass it on,” we follow the State’s published maximum pass-on rate.
• Service/processing fees from ticketing platforms may be additional.
3) Refunds, reschedules, and force majeure
• All sales are final unless the event is cancelled with no rescheduled date.
• If postponed, original tickets are honored for the new date; refunds (if any) follow the platform’s policy.
• We may modify the lineup, set times, seating/GA configuration, or venue. These changes aren’t grounds for a refund.
• Weather, acts of God, public safety orders, power outages, transportation failures, or permitting issues may force changes or cancellation without liability beyond any refund expressly offered.
4) Entry & security
• Government-issued photo ID required; name on ticket must match attendee when requested.
• No re-entry without venue policy approval.
• Prohibited items include: weapons, drugs, outside alcohol, glass, drones, laser pointers, professional audio/video gear unless pre-approved. Bag checks and magnetometers may be used.
• We may deny or revoke entry for safety, intoxication, harassment, or non-compliance.
5) Age restrictions
• Posted age limits (e.g., All-Ages, 18+, 21+) are enforced. Minors must be with a responsible adult if required by the venue.
6) Alcohol
• Alcohol service (if any) complies with the County of Hawaiʻi Department of Liquor Control. Some events/venues will require a Special License (Class 10) or other permit; hours and service areas are strictly controlled. We reserve the right to refuse service.
7) Health, safety & noise compliance
• Attendees must follow health/safety rules, posted instructions, and lawful orders from staff or public officials.
• Events must comply with Hawaiʻi DOH Community Noise Control rules (HAR 11-46). Certain venues/times have strict sound limits (e.g., 7:00 a.m.–10:00 p.m. “daytime,” 10:00 p.m.–7:00 a.m. “nighttime”), and exceeding limits without a permit/variance is prohibited. We may adjust volumes/schedules or end performances to comply with law.
• If a noise permit/variance is required by DOH, we’ll obtain it; permits/variances can impose monitoring and reporting conditions.
8) Venues, parks, and location-based permits
• Some sites (county pavilions, parks, beaches, or state parks) require County Special Activity Permits or State Parks Special Use Permits, plus insurance naming the government as additional insured. Events within the Special Management Area (SMA) may also need SMA approvals. Scheduling, hours, capacity, traffic, security, sanitation, and amplified sound can be conditioned by the permit.
• Where required, you agree not to interfere with permit conditions (e.g., quiet hours, parking, beach access) and to follow any onsite ranger or staff instructions.
9) Combat-sports events (boxing/MMA) and “slap” contests
• Boxing and MMA events in Hawaiʻi require licensed promoters and individual event permits/sanctions under State law and rules (HRS ch. 440, HRS ch. 440E; HAR 16-74). Ringside physicians, inspectors, reporting of receipts, and other safety/compliance measures are mandatory. Entry is contingent on us obtaining and maintaining all required licenses/permits.
• “Power Slap”/slap-fighting: As of today, Hawaiʻi statutes and commission rules do not expressly authorize slap-fighting as a sanctioned combat sport. Do not assume legality. Any such event would require explicit commission approval; otherwise it cannot be held. We reserve the right to cancel or reclassify any proposed slap event pending regulator direction.
10) Photography, recordings & publicity
• By entering, you grant us and our partners the right to capture, live-stream, photograph, and record your likeness/voice, and to use those recordings globally in any media for promotional and archival purposes, without compensation. Personal non-commercial photos/video are allowed unless the artist/venue forbids it.
11) ADA accessibility
• We follow the Americans with Disabilities Act and Hawaiʻi law. For reasonable accommodation requests, please contact us at least 10 days before the event.
12) Assumption of risk; release; indemnity
• Live events can involve loud sound, strobe/lighting effects, crowds, physical activity, and changing weather/ground conditions. By attending, you assume all ordinary risks and release us, the venue, artists, and contractors from liability for non-negligent injuries or losses.
• You agree to defend, indemnify, and hold us harmless from claims arising from your misconduct or violation of these Terms.
13) Prohibited conduct
• Harassment, hate speech, fighting, unsafe moshing/crowd surfing, vandalism, unauthorized vending, counterfeit tickets, and trespass are prohibited. Violations may result in ejection without refund and referral to law enforcement.
14) Governing law & venue
• These Terms are governed by Hawaiʻi law. Any dispute shall be brought exclusively in the Third Circuit (County of Hawaiʻi) or the U.S. District Court for the District of Hawaiʻi.
15) Changes
• We may update these Terms at any time. The version posted at the time of your ticket purchase governs that purchase.
